I got a ticket in Nebraska for Driving while Suspended, but I have never had a license here, the DWS is from the state of Oregon. Can you do jail time here for that?

If your driver's license was issued in Oregon and it is suspended now in OR than your driver's license is suspended in all states. When your state of licensing suspends, revokes, etc your license than you are now able to drive in any state since other states would require you to have a valid license in order to operate a vehicle.

So while it may be Oregon that suspended your license Nebraska can cite you for driving while suspended (DWS) if they run your driver's license and find that it is not valid.

There are many laws in NE that discuss driving with a suspended license. The ones that seem to be most relevant to your situation include the following sections:

60-486 states that no person shall be licensed to operate a motor vehicle by the State of Nebraska if such person has an operator's license currently under suspension or revocation in this state or any other state or jurisdiction in the United States.

60-557 notes that any person whose license, registration, or nonresident's operating privilege has been suspended or revoked under the Motor Vehicle Safety Responsibility Act and who, during such suspension or revocation, drives any motor vehicle upon any highway or knowingly permits any motor vehicle owned by such person to be operated by another upon any highway, except as permitted under the act, shall be subject to section 60-4,108.

60-4108 in part states that any person so offending shall (a) for a first such offense, be guilty of a Class II misdemeanor, and the court shall, as a part of the judgment of conviction, order such person not to operate any motor vehicle for any purpose for a period of one year from the date ordered by the court and also order the operator's license of such person to be revoked for a like period and (b) for each subsequent such offense, be guilty of a Class II misdemeanor, and the court shall, as a part of the judgment of conviction, order such person not to operate any motor vehicle for any purpose for a period of two years from the date ordered by the court and also order the operator's license of such person to be revoked for a like period. Such orders of the court shall be administered upon sentencing, upon final judgment of any appeal or review, or upon the date that any probation is revoked, whichever is later.

As the Nebraska Revised Statutes listed above note it is a misdemeanor to drive in NE while your license is suspended. In Nebraska a Class II misdemeanor comes with maximum penalties of 6 months imprisonment, or $1,000.00 fine or both. Some sources we have seen say that you may be able to lower it to a Class III misdemeanor. If that is the case than the maximum penalties for this is 3 months imprisonment, or $500.00 fine or both.

So jail time is a potential penalty that a Nebraska court can hand you as well as a fine to pay. You should contact the court listed on your NE ticket for driving with a suspended license to find out more about the penalties you could receive.
