I have an insured who is a resident of TEXAS and had an accident while traveling in Alabama. Would the TX resident who holds a Texas Driver's Licence be required to file a SR-13?

Yes, according to the information we have read from the Alabama Department of Public Safety (DPS), an out of state driver does have to file a SR-13 form.

The AL DPS has a fact sheet about the SR-13 accident report which states that out of state drivers must file the SR-13 if there is property damage greater than $250.00.

Alabama requires those who have been in an accident where there is more than $250 worth of property damage to fill out a SR-13, Safety Responsibility Accident Report. It contains information on the accident and your insurance coverages which AL law mandates that you turn in so they can have on file if there are issues arising from the incident.

According to the information and instructions listed on the form itself, completion of the SR-13 form is required by section 32-7-1 of the Code of Alabama. Completion of this form is required ONLY if a motor vehicle accident occurring in Alabama caused death, personal injury, or property damage to any one owner in excess of $250.

Thus if the accident resulted in property damage over $250, personal injury or death than even though your insured was only traveling through AL but lives and is licensed in Texas they must still fill out this accident report and turn it into the Alabama DPS. 

If your insured needs help filling out the form they may want to seek help from an AL DPS representative.
