- If you have not received a citation within the last three years.
- If you have not attended traffic school in the last three years.
- If an accident was not involved.
- If the citation was not issued in a highway work zone or a school zone.
The qualifications in Medford, Oregon for the traffic program are as follows:
- You were cited for a single moving violation that does not involve an accident or mandatory doubled fine (refer to the fee schedule below).
- You have no previous moving violation convictions or traffic crimes anywhere within the last two years.
- You have not participated in a traffic school program anywhere within the last two years.
- You have a valid non-commercial drivers license or permit.
We were able to find on the traffic school application from the Deschutes County, Oregon traffic court site and what their eligibility requirements are for traffic school. Here it notes that to apply for the Traffic Safety School program you must understand that:
- You cannot have had a conviction or diversions for a moving violation within the 5 years immediately preceding the date of this citation.
- You cannot have other pending moving traffic citations in this or any other court.
- You agree not to receive a citation for a moving violation within the next 90 days.
- You must successfully complete a court approved Traffic Safety School program and provide proof to the court in 90 days.
- If you comply with the conditions of this division program than this traffic citation will be dismissed by the court.
- If you do not comply with the conditions of the diversion you will be prosecuted for this traffic citation.
Unfortunately the Deschutes County traffic court is pretty strict and you cannot do traffic school if you have already have a diversion for a moving violation within 5 years. Thus it does not appear you will be eligible for traffic school for your latest ticket since you have been cited for a moving violation and taken traffic school within the last year and a half.
You can however contact the Deschutes County court listed on your citation to double check the eligibility for traffic school and see if there is any way for you to take it for your speeding ticket. If not you may see what your options are or if you will just end up pleading guilty and paying a fine.
