How do non-moving violations like failure to use child safety restraint effect insurance?

First a child safety restraint ticket is normally considered by the state and insurance company to be a moving violation.

Moving violations typically involve the vehicle to be in motion and thus include speeding, running a red light, failure to yield, reckless driving and even seat belt violations. Non-moving violations would tickets that do not deal with the vehicle being in motion such as parking tickets, failure to produce insurance card, not renewing your plates, etc.

Illegal vehicle modifications or faulty equipment can also be considered to be non-moving violations. If your window tint is darker than the law allows or if you have illegal lights on your car, a police officer may issue you a ticket. These infractions count as non-moving violations no matter if you received the ticket while parked or after being pulled over by an officer because they are problems whether your car is moving or not.

Not wearing your seat belt or having a child properly using their car seat or safety restraint is considered a moving violation since these devices need to be used while you are operating the vehicle. You cannot get ticket for these items if you are parked and not in motion. Law enforcement is concerned about everyone using their safety belts and restraints while the car is in motion.

So typically non-moving violations include:

  • Expired registration
  • License not on person
  • Equipment ticket – i.e. lights required on vehicle
  • Unlawful use of license plate
  • Driver’s license address incorrect, not changed
  • No proof of insurance
  • Parking ticket

Speeding tickets, DUI, reckless driving, child restraint and seat belt tickets are all considered moving violations and thus could affect your insurance rates. If you or others are not using your seat belts than you could potentially be more severely injured in an accident and thus more of a risk to an insurance company.

It depends though upon your insurance company's rating system whether your rates will go up due to a ticket for a child restraint violation since insurance company guidelines vary. Your agent should be able to tell you about your insurance provider's rating system and if this type of offense will affect your insurance premiums.
