According to the Mississippi Department of Public Safety (DPS) if you move to Mississippi, you must obtain a Mississippi Driver License within 60 days. You must obtain a Mississippi license plate (tag) within 30 days. You will need to contact the tax collector's office within the county that you reside for car tag information. In addition, you must also obtain a Mississippi Inspection Sticker for your vehicle.
To obtain a MS driver's license you must:
- Surrender any and all driver licenses from other states;
- Show your social security card (non-metal);
- Have a clear driving record nationwide;
- You must pass a vision test;
- Pay a fee of $20.00 (no checks accepted) for a four-year license if over 18 years of age. If under 18 years of age $5.00 for a one-year license;
- If you possess a valid out-of-state license you are not required to take the written test.
As you can see under #3 above you must have a clear driving record nationwide. What the MS DPS is referring to is a check of your name into the National Driver Register (NDR) which lists "problem driver." This means those drivers with DUIs, suspended, revoked or cancelled licenses as well as other violations that States in general believe to show that a person is a problem driver and should be listed in this nation wide database.
Also Section 63-1-9 of the Mississippi Code in subsection (c) notes no driver's license intermediate or temporary learning permit is to be issued to any person whose license to operate a motor vehicle on the highways of Mississippi has been previously revoked or suspended by this state or any other state and/or territory of the United States or the District of Columbia, and such revocation or suspension period has not expired.
So it appears that you cannot get a Mississippi driver's license while your Texas license is still under suspension. Normally to get a license in another state, since all states check the NDR before issuing licenses to those that apply, one must take care of any issues out of state and get their license reinstated. So if your TX license is suspended due to an unpaid ticket than likely you are going to have to not only pay the ticket but have to pay to get your license reinstated in Texas so that you can apply for a MS license.
