Where do we find an LOP form for the state of Florida?

An LOP is a Letter of Protection and is typically something that a lawyer prepares. We will give examples related to auto insurance injuries since that is what we are familiar with, though LOPs can be used in other situations.

Letters of Protection are basically a written promise by a lawyer to a third party to protect that party’s interests in the settlement of the lawyer's client’s case. So if there is an auto insurance personal injury claim or lawsuit that a lawyer is handling they may type up a LOP and give to the doctor(s) that are waiting to be paid for their services to the client.

A doctor may also draw up their own Letter of Protection, probably prepared by their lawyer or by getting a generic legal LOP form from a legal resource center, to have their client sign who is in a lawsuit regarding the medical bills resulting from an auto accident. The doctor would do this so that they have an assurance by their patient and their lawyer that unpaid medical expenses the patient has thus far racked up will be paid out of the settlement of the insurance claim or litigation.

The letter of protection is considered by some a document which allows the patient to continue medical treatment without having to pay for it until a later date. Normally, there is no reimbursement made until the patient reaches a full recovery either by a claim being settled or a lawsuit being settled. The patient (lawyer's client) needs to realize in this sort of situation that if the case or claim is not resolved in their favor, a letter of protection on file does not keep them from being held personally responsible for paying off their medical bills.
