I'm a Texan. I received a photo radar ticket in Arizona. Will it go on my record in Texas?

Yes, from the information we received from the Texas Department of Public Safety your Arizona photo radar ticket will go on your TX driving record if you are convicted of this violation.

As you may be aware, both Texas and Arizona are members of the Drivers License Compact (DLC) so if you are convicted of the photo speeding offense in AZ than their courts would inform the TX Department of Public Safety (DPS). This is because the DLC requires member states to notify the licensing state of a driver if the individual is convicted of moving violations, such as speeding. It then is up to the person's home state to decide if they will put the out of state ticket on the person's driving record and assign points.

According to the Texas Department of Public Safety they will place out of state offenses onto your TX driving record. The Texas points system lists that it is 2 points for a moving violation conviction in Texas or that in another state. Points however are not assigned for speeding less than 10% over the posted limit or for seat belt convictions.

So if your Arizona speeding citation (photo radar ticket) falls into the less than 10 percent over the posted limit that it does not appear you would receive points for the violation conviction though it would still be listed on your TX motor vehicle record. We checked to verify this information and a TX DPS representative told us in response that out of state photo radar tickets are processed just as other out of state speeding tickets written up by officers are and thus would go on your Texas MVR.

Since the Arizona speeding photo citation will be placed on your TX driving record if you are convicted of it than your insurance company will see it the next time they pull your MVR. To find out if this speeding ticket will affect your rates you would need to find out about your specific insurance company's rating system. Usually you can find out about a rating system by asking your agent or the TX Department of Insurance since your insurance company's rates must be filed with this state agency.

We have read that you may be able to take a traffic school to dismiss the AZ photo radar ticket so you should see if that is an option in your case to keep the ticket off your TX motor vehicle record by not being convicted of the violation in Arizona. Try calling the court listed on your citation to see if you have a traffic school option which would keep the ticket off your TX driving record and from affecting your insurance rates.

car insurance commentsArizona law requires that all complaints, including traffic tickets, be personally served. Your appellate court has thrown out cases where a photo radar ticket was mailed. Your courts have no power to assess fines or sanctions unless the complaint was served or service was waived. In other words, a ticket is just like a lawsuit. It has to be served the same as if it were a personal injury suit, breach of contract suit, or any other lawsuit. So, looking again at that ticket that came in the mail, if the driver signs and returns it, the driver is waiving the legal requirement that the city serve the complaint personally.
