My record has been clean for nearly 3 years. I was recently ticketed in Tucson, AZ for doing 48 mph in a 35 mph zone. How many points am I likely to get for this and would going to driving class benefit my record? Thanks for the response.

The Arizona Motor Vehicle Division (MVD) lists speeding violations as being worth 3 points on its points assessment list. In AZ a conviction for a traffic offense stays on your driving record for 5 years from the date of the conviction. Any convictions received and showing on your driving record within the past 39 months will be provided to an insurance company.

The Tucson court's online site notes that Arizona statutes allow you to remove one moving traffic violation from your driving record every two years by completing a defensive driving class. You may be eligible to attend Defensive Driving School (DDS) if you meet ALL of the following conditions:

  • Your citation was for a civil moving violation, and
  • You have not attended a defensive drive class for any Arizona civil traffic violation in the last 24 months, and
  • Your citation was not issued as the result of a collision in which any person was seriously injured or killed, and
  • Your case is not set for a hearing, and
  • You are not a Commercial Driver License (CDL) holder since CDL drivers are not eligible for Defensive Driving School.

The advantages that the court lists for taking the defensive driving school (traffic school) program include:

  • You will not have to go to court for that charge
  • That charge will not be reported to MVD
  • There are no points against your license for that charge

It is stated that you must enroll and complete DDS seven days prior to the court appearance indicated on your traffic ticket so if you are trying to decide about taking it you should contact the court to make sure you are eligible and then complete it before your court date if you choose this option.

So it is 3 points on your driving record and a speeding violation placed on your motor vehicle record (MVR) if you are found guilty and are convicted of your speeding citation. If instead you choose to take the DDS option than neither the speeding charge nor points will be placed on your driving record. This means your auto insurance company will not be able to rate you on this offense so your Arizona car insurance premiums would not be raised due to this ticket since with the traffic school option it is not placed on your MVR.
