Yes, if you are convicted of this 16 mph over speeding offense the courts will notify the Delaware Division of Motor Vehicles (DMV) which will then place the speeding violation on your motor vehicle record (MVR) and assign it points.
In Delaware speeding ticket convictions are usually assigned the following amount of points:
- 1- 9 mph over the posted limit is 2 points
- 10 -14 mph over the posted limit is 4 points
- 15-19 mph over the posted limit is 5 points
- 20 mph or more over the posted limit is 5 points
So if you are convicted of going 41 in a 25 than you would receive 5 points on your DE driving record by the DMV. According to their points schedule and information points are credited at full point value for the first 12 months from the date of violation. After the initial 12 months have expired, the calculated points will be credited at one-half point value for the next 12 months. All actions that the DE DMV may take are based upon total calculated points within a 24-month period following the offense.
In Delaware when you have accumulated 8 points the Division of Motor Vehicles sends the driver an advisory letter. If you get 12 points than you must complete a behavior modification/attitudinal-driving course with-in 90 days after notification (unless extended by DMV). Failure to comply or upon preference of the driver, mandatory 2-month suspension will be imposed.
If your points get higher than you will receive a mandatory license suspension and to become eligible for reinstatement, you must complete or have completed a behavior modification/attitudinal-driving course within the previous 2 years. At 14 points it is a 2 month suspension, 16 points is a 4 month suspension, 18 points is an 8 month suspension, 20 points is a 10 month suspension and 22 months is a 12 month suspension.
