The State of Arkansas Office of Driver Services uses an “Administrative Point System". Arkansas driving records are governed by Arkansas code section 27-50-901. Here it states that the AR Office of Driver Services of the Revenue Division of the Department of Finance and Administration (DFA) shall establish and maintain a central driver's records file on every driver who receives a conviction for a moving traffic violation while operating any motor vehicle subject to registration for highway use, whether such conviction occurred within this state or in another state.
Points are assigned for various traffic violations ranging from three (3) points to eight (8) points. The information found through the Arkansas DMV showed that a driver's license will be suspended at 14 points. The length of time that the license is suspended varies based on the total number of points. For example: drivers with 14 to 17 points may be suspended for three months; 18 to 23 points may be suspended for six months; and 24 or more points may be suspended for up to one year.
A hearing can be requested before a suspension takes place. The state sends a warning letter at ten (10) to thirteen (13) points. The hearing provides the licensee an opportunity to plead their case and the court may decide to allow the removal and or reduction of points. Once a suspension has been made, a hearing is automatically scheduled and the driver is subject to the Hearing officer's discretion. The driver can still plead their case to keep the process fair and actions of the court can range from no action to probation, restriction, or suspension of the license. Failure to attend the hearing results in automatic suspension of the license.
