I am currently separated from my spouse and waiting for the divorce to become final. She has a car that is in both our names and I have a car this is both of our names. Obviously, she will no longer be driving mine nor will I ever drive hers again. My question is do we still have to have coverage for both of us on both vehicles or can I simply obtain my own insurance for just myself on my vehicle? I am in Florida.

In the state of Florida, you and your spouse are both legally responsible for each other and for the property owned until your divorce is complete.

There are insurance carriers who may allow the vehicles to be listed on separate policies and the additional owner(s) to be excluded on the policy and then allow the removal of the driver with proper documentation of the divorce. The insurance companies who allow this often have a minimum length of time that the couple has been separated in order to be eligible, other insurers will allow the exclusion regardless of the situation.

Since you and your spouse are still responsible for each other in FL until the divorce is finalized you likely would each want to make sure the other has insurance on the vehicle each drives so that the other could not be held liable for an accident the other one has due to finding that insurance had been taken off the vehicle.
