You will need to contact the court listed on your speeding citation and possibly the Massachusetts Registry of Motor Vehicles (RMV) to discuss your specific situation and determine if your driver's license will be suspended by this speeding ticket however to the best of our understanding it would not be.
As you mentioned you are no longer under the MA junior operator's license (JOL) rules since you are over the age of 18. In Massachusetts a driver ceases to be a junior operator when he or she turns age 18, although penalties will still apply for offenses committed while a junior operator. So if you had received this second speeding ticket while you were under the age of 18 and still a JOL but then turned 18 before you were convicted of the offense you could have been penalized according to the JOL laws.
In MA the law requires a mandatory suspension, in addition to any other penalty, fine, revocation or requirement that may be imposed, for a conviction of speeding or drag racing by a holder of a JOL. For speeding, you will receive a suspension of 90 days for a first offense, and one year for a second or subsequent offense for any combination of violations of the following laws:
- Conviction for Speeding (speeding on a way) Massachusetts General Law, Chapter 90, Section 17; (c.90, §17)
- Conviction for Speeding on certain highways (speeding on portions of Mass Pike, portions of I-91, portions of I-95). (c.90, §17A)
- Conviction for violating special speed regulations (set by cities, towns, state highway department). (c .90, §18).
As we mentioned earlier the conviction need not occur while you are still under age 18, only the offense. Since you were already over 18 when you received this second speeding ticket you should be okay with regards to the JOL 1 year suspension for a second speeding ticket.
What you have to be careful of now is not getting any other traffic tickets. According to the MA RMV there are laws that require the Registrar to suspend or revoke a permit or driver's license or right to operate automatically in several instances. Examples of such instances include, but are not limited to:
- Three Speeding Violations (within a one-year period)
- Habitual Traffic Offender
- Seven Surchargeables
- Five Surchargeables
- Junior Operator License Speeding
So if your first 2 speeding tickets have been in the say 1 year period than you need to be careful not to get a third speeding ticket and end up with a suspension due to 3 speeding convictions in a one year period.
