We live in Tennessee. My husband and I were in an accident. The other driver was found to be at fault. We did not have any insurance at all when the accident occurred. The other driver has liability insurance. Is their insurance company responsible for damages to our vehicle?

Yes, you should be able to make a third party claim against the at-fault party's Property Damage Liability coverage even though you were driving without insurance when the accident occurred in Tennessee.

Tennessee's financial responsibility (FR) law requires drivers to produce evidence of FR to an officer when charged with a moving violation or involved in a motor vehicle accident. According to the TN Department of Safety in Tennessee, failure to show proof of financial responsibility is a Class C misdemeanor whose penalty is a fine of not more than $100. Once the state is notified of a conviction for this offense, the violator’s driver's license will be suspended.

If at the scene of an accident you are unable to show proof of FR (car insurance) and convicted of the charge of failure to show evidence of FR, driving privileges will be suspended. Before reinstatement of the license, you would be required to submit proof of insurance, along with other administrative or court requirements.

Also a STOP will be placed against the vehicle's registration of the driver. If financial responsibility can be shown prior to the court date though they might be able to dismiss charges, the driver will need to submit proof of Financial Responsibility again to the TN Financial Responsibility Division before their registration is renewed.
