QuestionInsurance Question  My windshield was damaged by a gravel truck. My insurance deductible is more money than fixing the windshield. I have contacted the gravel truck company. On their claim form, they ask for my insurance information. Am I required to provide it to them? Why do they ask for it, since I am making the claim directly against them?

It sounds like you are filling out a generic claim form for the gravel truck company. If this is the case, they may be requesting your insurance company for various reasons.

Here are some examples why they request this information:

  • Some states require you carry Personal Injury Protection. This coverage will cover you to a certain amount before the gravel truck company's insurance has to pay anything. If this were an injury claim (which it is not), they would request this information because the state may set the PIP as primary and all other claimants as secondary.
  • The gravel truck may also be looking for your insurance information in case they have to subrogate the damages. In other words, instead of going through the gravel truck's insurance company, you go through your own insurance company. As a result, you give your insurance company the right to go after the gravel truck's insurance company to collect.

Neither of these appear to be the case. Ask the gravel truck's insurance company if your insurance company's information is necessary. And, if so, why?

Also, depending on the state in which you live, if you carry comprehensive and collision coverages, your insurance company should fix your windshield without you paying the deductible (Florida). In this case, your insurance company may subrogate the claim against the gravel company.
