QuestionInsurance Question  We were passengers in an accident. The other driver didn't have insurance. Our driver has uninsured motorist. The claims adjuster says since its an uninsured motorist claim, they don't negotiate on settlements. Is this true?

Settlements dealing with uninsured motorist claims may vary from state to state. However, there is usually one of three ways for settlements: 1) agreement between the injured person and the insurance company, 2) arbitration between the injured person and the insurance company, or 3) by lawsuit jointly against the insurance company, who refuses to arbitrate, and the other party. Remember, uninsured motorist coverage is 'excess' to applicable coverages. This means insurance companies will not pay duplicate coverage with the uninsured motorist coverage, if the injuries have already been covered by disability benefits, workers's compensation, personal injury protection, bodily injury liability, and medical payments.
