The insurance company will not cover the claim, because the driver did not have permission to drive the vehicle. I am not a lawyer but I believe the driver will be held accountable for his actions. The owner of the truck may also be held accountable for his actions (through vicarious liability). To keep you, your husband, and your company safe from litigation, I would seek legal help. And, as a result, you may have to sign an affidavit stating what limits of permission the driver had with your company's property.
