If insurance companies see a high coralation between accidents and cell phone use while driving, they might consider that when they determine their rates. Now, insurance companies are required to file their rates and rules with state regulatory bodies such as the Department of Insurance. To my knowledge, there isn't a 'law' that prohibits insurance companies from basing their premiums on drivers who use their cell phones when they drive.On the other hand, I have not heard of any insurance company charging increased rates because its insureds use cell phones while driving. It's just a matter of how the rates are filed and passed on to you.
