QuestionInsurance Question  In Florida, if I have separate medical insurance for myself and my family, "Medical Payments" auto coverage, and a high auto "Liability" coverage, what good would "uninsured motorist" coverage do me?

AnswerAuto Insurance Answer

In Florida, uninsured motorist (bodily injury) coverage will reimburse you, your family members or a driver of your vehicle if any of you are hit by an uninsured driver or a person that hits you and flees the accident scene. Depending on what your specific uninsured motorist policy says it is likely it would also pay for pain and suffering.

If you only have liability coverage on your policy and not physical damage coverage, you would not be covered for the damages to your car if it is hit.

The type of insurance you need, can only be determined by what you find are your specific needs. I would suggest discussing your auto insurance policy with your insurance agent so that you can determine if you need to add any new coverages. If CarInsurance.com is your agent, please call 1-800-964-4859 and asked to speak with a licensed insurance agent.

Comment Update: First, you are correct; there is no UM coverage available for property damage in Florida, but physical damage coverage provides coverage for your vehicle, regardless of negligence.

It is hard to interpret and convey which coverage in this situation would be primary, secondary, tertiary and then quarternary (fourth). But we will try to explain it with the information provided:PIP is the primary coverage over all other forms of medical and disability insurance coverages except Workers Compensation. Then, this is the order of recovery:

  1. Medical Payments Coverage - pays in excess of the 80& provided under PIP
  2. Liability Coverage
  3. Uninsured Motorist Coverage

The purpose of PIP (Florida No-Fault Law) is as an attempt to remove certain claims from the tort liability system and to substitute a system of benefits payable by one's own insurance.

Hope this helps.
