QuestionInsurance Question  My friend borrowed my car for weekend, but during the time he had he let someone else I do not know move my car. This person gets into an accident, hitting a wall and a tree to the point where the car can be considered totaled. After that, we find out that this person does not have a driver's license and that my policy had just lapsed which I was not aware of. Who is liable for this accident and do I have any recourse whatsover?

Even if your insurance policy had not lapsed it is doubtful that it would have covered this accident since the person was driving your car without permission. Insurance companies generally do not cover accidents in which the driver was using the vehicle without the owner's permission.

Your recourse is likely to only come about if you seek legal counsel and find out if your state laws would allow you to go after the driver that crashed your vehicle into the wall and tree. Hopefully the at-fault person is able to pay you for your totaled car. Once you have a new vehicle remember us when looking for insurance.
