QuestionInsurance Question  I believe my father in law is driving without a license. I believe he lost his license because of bad eyesight, he is 87 years old. He still drives anyway and believes he is still covered on his car insurance policy. We live in California. Can you tell me what could happen if he gets into an accident or gets a ticket?

In California, if a senior does not pass the vision test the DMV will schedule the person for a supplemental driving performance evaluation to see if the person can compensate for the vision condition. After this driving test the examiner has the right to immediately revoke the person's license if they showed themselves as unsafe to drive. The driver can request a hearing after receiving this notice of suspension or revocation.

If you believe you father lost his driver's license in this manner, in CA you can request a copy of someone else's license by filling out a form with the DMV. You should then be able to find out if his license has been suspended, revoked or restricted due to his poor eyesight. If you find out that he is driving illegally, due to the status of his license, you can write your local Driver Safety Office. Give them all of his information that you know and a description of the facts that make you believe he is driving unsafely or illegally.

If your father's insurance company does not have notice of him having an invalid license his policy is likely still in effect. This does not mean that they may not have the right to turn down a claim if he is in an accident since he would be driving without a license. If your father is caught driving without a valid license the CHP has the right to give him a citation as well as tow and impound the vehicle he is driving for 30 days or possibly find the auto to be forfeited to the state.
