QuestionInsurance Question  I just received my first ticket ever for going 90 in a 65. I got the ticket in GA, where I reside, however I have a FL driver's license. Can I get the ticket lowered as this is my first? Do you think that it will affect my insurance? How long do points stay on a drivers license?

AnswerAuto Insurance Answer

In Georgia, a speeding ticket for going between 24 mph but less than 34 mph over the posted speed is 4 points. Going more than 15 mph over the speed limit in Florida is also 4 points. While Georgia is not part of the Drivers License Compact, the GA Driver's Services will send moving violation to other state's DMVs.

According to Florida Department of Highway Safety and Motor Services (HSMV), if you have a FL license and receive a traffic ticket out of state once they receive the citation information it will be added to your driving record. You will receive points on your license, if the violation is a point-accessible violation according to Florida statute 322.27.

Both Georgia and Florida have defensive driving or traffic schools which typically you are allowed to attend to reduce points. But because this was an out of state violation, different rules apply. Florida law does not allow for any school or program to remove points for a ticket received in another state.

Points stay on your record and are counted against for 3 years in Florida so during this time your insurance rates could be affected, depending on your insurance company's rating system. To see if you can reduce the citation you will need to contact the court listed on your speeding ticket to see if it can be lowered before you are convicted of the traffic offense and the information is sent to Florida.
