QuestionInsurance Question  Years back I attended a driving school to remove points from my Florida driver's license. The instructor was a FL trooper and informed us of a state law that said after points have been remove, as long as it was a no accident ticket, the insurance could not raise our rates. He cited the FL statue numbers but I can't find them. Can you shed some light on this subject for me?

It sounds as if you received a ticket for moving violation in Florida and elected to attend traffic school instead of getting points put on your driving record. This can also be known as withheld adjudication or adjudication of guilt withheld.

According to the Florida Department of Highway Safety and Motor Vehicles (www.hsmv.state.fl.us/ddl/bdis.html) the benefits that come with this choice is that your insurance rates cannot go up and your policy cannot be cancelled due to this violation, unless it involved a crash where you were at fault.

Another benefit is that points are not added to your driver license record and the fine is reduced up to 18%. In Florida, you can only choose this option for moving violations 5 times in a lifetime and cannot have made this same election in the preceding 12 months.

I was unable to find a Florida statute that listed all this information but statute numbers 318.14 and 627.06501 both mention driver improvement schools. You can search the FL statutes at the Florida Statutes Website.

Be aware that it may not increase your rates in Florida, but it still can remove any discounts (like a safe driver discount) you were entitled to or receiving.
