QuestionInsurance Question  My friend was at fault in an accident. Both of the cars are registered in Maryland, but the accident took place in Virginia. My friend has insurance, but the other person did not. Is the other person liable to pay for the damages to my friend's car? The other party is saying that it's not his fault, thus he will not be paying for the damages. Can I file a complaint? What should I do and is there anyway to report this or have the other party penalized for not having insurance?

Typically if your friend was at-fault in the accident, than he or she would be the one responsible for the damages. The other person not having insurance does not normally make him responsible for the damages if he did not cause the accident. Hopefully law enforcement was called to the scene of the accident to help assign fault and to give the uninsured party a citation.

If the police were not called or the person was not cited so you want to report them for driving without insurance you can probably do so. In Virginia, car insurance is required and if a person is found without it the DMV can suspend the driver's license and registration of the operator of the vehicle and owner of the car. An SR-22 showing proof of insurance is typically also required.

If the person was cited in Virginia for being an uninsured they might have to face the penalties listed above. If they were not cited, you should try reporting them to the Maryland Motor Vehicle Administration since that is the state where they are licensed. In Maryland the penalties for being an uninsured driver can include lose of license plates and registration privileges, penalty fees, restoration fees, fines, etc.
