QuestionInsurance Question  I am an R.I. resident who had an accident with a rental car in Michigan. I received a ticket for "improper passing" for this accident. I paid $100 to keep my drivers license, because I am an out-of-state driver. The police said I have to call the court and set up a date for court appearance. If I am convicted of "improper passing", it will be 3 points.Will these points be transferred to R.I.? If so, will it affect my insurance premium?Also, I am planning to move to Michigan. Will these points apply to me when I apply for a new license in MI?

Your home state of Rhode Island is a member of the Drivers License Compact while Michigan is not. But the Michigan DMV has decided to report tickets back to the home state of motorists who get a MI traffic ticket but are licensed out of state.

Statutes of Rhode Island state the RI Division of Motor Vehicles is authorized to suspend or revoke the license of any resident if they receive a notice of an offense in another state, which if committed in Rhode Island would be grounds for suspension or revocation.

The statute I read did not say for certain but likely once RI is notified of the Michigan improper passing conviction the offense information will be added to your Rhode Island driving record.

If the Michigan traffic violation makes it onto your RI driving record it could affect your insurance rate. It will ultimately depend upon your insurance company's rating system, which you contact them to find out specifics on.

To find out when you move to Michigan if this past offense will be placed, with or without points, onto a new MI driver's license, you will have to contact the Michigan Driver's License Division.
