QuestionInsurance Question  I live in Missouri and have car insurance with medical payment included in my yearly premium. Is my insurance co. required to pay for medical bill received when someone rear-ended me? I have paid for this coverage and now they say the are not going to pay, please advise.

AnswerAuto Insurance Answer

The Missouri Department of Insurance guide to Auto Insurance lists medical payments insurance as an optional type of car insurance one might purchase that pays for your medical costs up to the limit stated in the policy.

Medical payments insurance normally covers you or your family for injuries sustained while in your car or as a pedestrian struck by a motor vehicle. Some policies also cover you when you are in someone else’s car. Passengers in your car also are covered. This type of insurance usually also covers funeral expenses in connection with an automobile accident.

Some medical payment insurance policies however may only pay the amount not covered by other collectible health or accident insurance. So if you have health insurance that your insurer believes that you should use to pay for the medical expenses, this may be why they are not paying on your claim. Or since you were rear-ended, your insurance company may want you to put your medical bills through the at-fault party's bodily injury policy.

I would suggest getting more information from your insurance company on the reason why your medical payment insurance coverage is not covering this accident. If you do not get an acceptable reason or do not feel you are being treated fairly, contact the Missouri DOI for consumer help.
