QuestionInsurance Question  I have a West Virginia drivers license and got pulled over speeding in Maryland going 96 in a 65. The officer marked my ticket as negligent driving and said that all I need to do is pay the fine in 15 days and I would not have to go to court. How many points would I get for this and will me insurance (Geico) go up at all? This is my first speeding ticket.

West Virginia and Maryland both take part in the Driver's License Compact so the Maryland courts or Motor Vehicle Administration will report this speeding/negligent driving citation back to West Virginia's Division of Motor Vehicles.

The WV Division of Motor Vehicles has a point system to identify and control problem drivers and also maintains a record of all violations of traffic laws. Your record will show the date, nature of the violation and the court in which you were convicted no matter whether the offense happened in or out of state.

The WV driver's manual states that traffic violations you receive in other states will become part of the driver's WV driving record and on the WV DMV points violation page it notes that points are assessed for all traffic violations committed anywhere in the US. Drivers convicted of multiple offenses arising out of the same incident will be assessed only the points appropriate to the most serious offense.

The number of points assigned for the negligent driving offense in Maryland depend upon if the West Virginia DMV sees it as speeding or as reckless/careless driving. Speeding 15 mph or more above posted limit 5 points while reckless/careless driving is 6 points.

In West Virginia points remain on your driving record for two years from the conviction date while the infraction itself remains on the driver's record for seven years. If you accumulate 6 points or more on your record, the DMV will send you a letter of caution. If you accumulate 12 points on your record, your driver’s license may be suspended.

To find out if your insurance provider, Geico, will change your rates does to this traffic ticket, you will need to contact them directly and find out about their rating system. Some insurance companies may not raise rates for you first ticket while others might, especially since the ticket was for 30+ mph over the speed limit.
