QuestionInsurance Question  I live in Florida and have a motorcycle registered in Florida. Florida does not require PIP and liability on Motorcycles. I went into Georgia to eat supper and received a ticket for no proof of insurance which with no insurance will carry a $600.00 fine and a criminal charge in the state of Georgia. Are there any laws about requirements of your home state that I can reference regarding this situation?

Typically when you are driving from one state to another once you enter the new state's territory you are subject to their laws and statutes. Georgia as you know has different laws governing motorcycle insurance than Florida does and it is our understanding once your vehicle crosses over the state line into GA, you need to abide by their laws.

Georgia code 40-6-11(b) states that no owner of a motorcycle or any other person, shall operate or authorize any other person to operate the motorcycle unless the owner has liability insurance on the motorcycle equivalent to that required as evidence of security for bodily injury and property damage liability. Any person who violates this subsection shall be guilty of a misdemeanor.

In general if you have motor vehicle insurance your policy limits will be interpreted by your insurance company to provide you with at least the minimum limits required by the laws of the state in which you are operating your vehicle. Since you did not have insurance on the motorcycle there was no policy to cover you in Georgia which they require.

Since your motorcycle was from out of state you may want to see from the Georgia court listed on your ticket if they will take this into account and if there is a way to reduce or dismiss the charge. You may need to seek legal counsel to see if this is possible and see if there are any specific laws from your home state, Florida, that you can reference as you asked about.
