QuestionInsurance Question  I have been a NYS licensed driver since 1973 with an absolutely clean record. In 9/05, I received a summons under the NYS Navigation Law for operating a jet ski in excess of 5 mph in a no-wake zone. I was fined $50. I ran my NYS Abstract of Driving Record & the conviction appears as "boat conviction - speeding - vessel". I am confused, a drivers license is not required under NYS law to operate a jet ski & I was not required to produce it at any time. By what authority is this being counted on my driving record? I know it is because an insurance agent advised me that I couldn't switch to their company because of it.

In general your driving record is a history of your operation of motor vehicles, which can include cars, motorcycles, boats, etc. In many states you do not have to have a driver's license in order for the state to start a driving record or motor vehicle record (MVR) on you.

The NYS Navigation Law does state that the department of motor vehicles shall maintain a record of all convictions and accidents and since you do have a driver's license and driving history already started it would appear that is where your maritime violation was also placed. You will need to check with the New York Department of Motor Vehicles to find out exactly why the jet ski speeding / no wake violation is on your driving record and how long it will remain there.
