QuestionInsurance Question  My daughter, while she was insured under us, had to make a claim for a fender bender in 2004. Now she has her own car and her own policy but my insurance company is still charging me for my daughter's claim. Is this correct?

Yes, even though your daughter now has her own car with its own auto insurance policy on it, normally the claim that your insurance company paid in the past for her could still affect your rates. State laws can differ regarding this so you can check with your state's insurance regulator to find out what your state insurance laws allow.

If this surcharge is allowable, it would be due to a person on your policy having a claim paid out on their behalf. Even though she is not longer on your policy this previous claim was still paid out with your insurance company's money and under your policy. Insurance companies can thus use this claim history (or claim paid) as a factor for calculating your rates.
