QuestionInsurance Question  I am the victim of a hit & run accident, however I live in Michigan, a no-fault state, but I do have full coverage including Personal Injury coverage. During the accident, my passenger was injured and had to visit the hospital. The police officer who reported to the accident had told us to give the hospital my car insurance information, and that it would cover the medical costs. When my friend got there, they said mine did not cover it, even though it was my vehicle involved, and they asked for her car insurance. She does not own a vehicle, and does not have car insurance. Why wouldn't my insurance cover her? Also, I was told buy numerous people, that because it was hit & run I would not have to pay the deductible. But my insurance company says I do. Why is this?

According to the Michigan Insurance Consumer Information Sheet put out by the Office of Financial and Insurance Services (OFIS) a no fault policy covers all family members living in the same house. Personal injury protection benefits will be paid even when a family member is a passenger in another person’s car or is a pedestrian when an accident takes place.

The fact sheet also states that the personal injury protection coverage of your no-fault policy also covers anyone who does not have a no-fault policy and is hurt as a passenger or pedestrian in an accident involving your car. From this information it would appear that your passenger should be covered under your PIP coverage if she does not have her own car insurance policy to cover her injuries she sustained in your car.

The hospital may have just been unaware that she did not have insurance coverage of her own. If she did have her own car insurance policy then even though the accident was in your car her own PIP coverage would have been who she would need to place a claim with.

We know of no MI law saying that there is not a deductible for a hit and run claim with your auto insurer. It may be that some insurance companies have decided to waive the deductible for hit and run claims but that your insurer is not one of them. To find out for certain if your insurance carrier should waive your deductible in your situation, contact the Michigan Office of Financial and Insurance Services.

It could also depend on the type of collision coverage you gave and are making a claim on. There are three kinds of collision insurance you can choose from: limited, standard, and broad form. The OFIS fact sheet mentioned above has a chart of when deductibles are due. From this it would appear that if you have broad form collision coverage then a deductible may not be due. Spec with your insurance agent about your specific coverages to find out for certain.
