QuestionInsurance Question  My boyfriend and I just received a traffic ticket for expired tags. We are both on my insurance and were both present in the car when the ticket was given. I am the vehicle owner, but I wasn't driving. My boyfriend was issued the ticket and I was wondering for one why wasn't I the one who got the ticket, and two how much will that increase my insurance premium? Will my rates go up? We are in Arkansas.

Arkansas Motor Vehicle and Traffic Law 27-14-701 addresses the registration requirements. Here it states that it shall be a misdemeanor for any person to drive or move, or for an owner knowingly to permit to be driven or moved, upon any highway, any vehicle of a type required to be registered under this chapter which is not registered within the time period prescribed by law, or for which a certificate of title has not been issued or applied for within the time period prescribed by law, or for which the appropriate fee has not been paid when and as required under this chapter.

Since it is a violation of the law for person to drive a car with expired tags (registration) or for the owner to allow a person to drive a car with expired plates it is likely up to the discretion of the law enforcement officer to write the ticket to the driver or to the vehicle's owner. In your case it would appear the officer chose to ticket your boyfriend since he was driving the car at the time.
