QuestionInsurance Question  I got a DUI almost 5 years ago and I was required to file an SR-22 with the the Virginia DMV (I am a Virginia resident). Recently my policy was up for renewal and I noticed that my insurance company is still quoting me for the SR-22 filing. Would the insurance company remove the SR-22 filing when it is no longer required or would it be up to me to remove it? Also, how long am I required to have an SR-22 filing in Virginia for a misdemeanor DWI? I've been shopping around with other insurance companies and none of them have quoted the SR-22 filing.

The time one must carry a SR-22 may vary in Virginia but typically it must be held for 3 years after a DUI/DWI convictions. The Virginia Department of Motor Vehicles site states that when three years have elapsed from the effective date of the suspension, the DMV relieves the vehicle owner of the requirement of furnishing proof of financial responsibility. To see if this is true for your situation contact the VA DMV.

If you find out that you no longer need to carry the SR-22 then it would be up to you to inform your insurance company. The insurance carrier should then send the state a SR-26 showing that you have terminated your SR22.This is a form showing the cancellation of SR-22 financial responsibility certificate insurance.

Without you informing your insurance company when it is time to end or remove the SR22 certificate they will continue to keep it and quote you the renewal rate with it on your policy. Other insurance providers would not quote you rates with a SR-22 unless you would advise them that you need a policy with this financial responsibility certificate.
