QuestionInsurance Question  We have California PLPD coverage on our daughter's car. She was in a hit and run accident(not her fault). The insurance says that since they can not identify/find the driver that hit here, she is not covered for the repair of the auto, under the uninsured policy and that her medical bills are not covered either. How can this be? They say the the girl in her car is covered but not her. Any info would be nice.

According to the California Department of Insurance an uninsured motorist bodily injury policy (UMBI) policy should cover you and your passengers for bodily injury caused by a negligent uninsured motorist, a hit-and-run driver, or by a driver whose insurer is insolvent.

Even though the hit and run driver (phantom driver) was not found usually your UMBI would cover you and your passenger's injuries so you will want to get more information from your agent to find out why your medical bills will not be covered. Also read through your policy terms since some companies include in the policy that hit and runs are only covered if the other driver is legally liable because of negligent driving.

You should also be aware that most policies require notification of police within a specified time period if the accident is a hit and run. Some policies for uninsured motorist property damage and bodily injury state that there must be witnesses to the driver leaving the scene of the accident or the hit and run driver must be identified and found to be uninsured. Again read through the terms of your policy to see what it states.
