QuestionInsurance Question  I was involved in a accident in Kansas and after contacting the insurance company to make claim they told me I was not covered but never gave me any notice. What can I do?

Without knowing why or how you were canceled the only advice we can pass on is to find out this information from your insurance company.

If after you get information on your cancellation and believe it was not correct or that you did not receive proper notice you can contact the Kansas Department of Insurance to seek consumer help.

According to the KS DOI's auto insurance brochure, during the first 60 days of coverage under a new policy, the insurance company can cancel you for any lawful reason. After 60 days, Kansas statutes specifically state your personal automobile insurance policy may not be cancelled except for the following reasons:

Non-payment of insurance premium and/or any installment when due.

Insurance obtained through fraudulent misrepresentation.

Insured violates any of the terms and conditions of the policy.

Insured, a family member, or person customarily operating your motor vehicle with permission has: a) driver’s license suspended or revoked during policy period, b) subject to epilepsy or heart attacks and cannot produce a physician certificate indicating the insured’s ability to operate a vehicle, c) convicted during the 36 months immediately preceding the effective date of the policy or during the policy period for:

  1. any felony
  2. vehicular homicide
  3. operating a vehicle while intoxicated or under the influence of drugs
  4. leaving the scene of an accident without reporting it
  5. theft of a motor vehicle
  6. making false statements on driver’s license application
  7. committing three moving violations within an 18-month period.

The company must give at least a minimum of 30 days written notice of their cancellation, except for non-payment of premium. There is no grace period for coverage and/or payment of premium when due. Always pay on or before your due date or your insurance will be cancelled.

If your cancellation did not fall under any of the above conditions and you were not given the required written notice then you may have an issue with your insurance carrier that you can bring to the DOI for help with.
