QuestionInsurance Question  What is the second (2nd) offense for driving without insurance and failure to satisfy in the state of Tennessee and was supposed to have an sr22?

AnswerAuto Insurance Answer

In Tennessee, failure to show proof of financial responsibility is a Class C misdemeanor whose penalty is a fine. Once the state is notified of a conviction for this offense, the violators driver's license will be suspended. If it is your second offense for being an uninsured motorist then the fines are likely to be higher and the suspension may be longer. You will need to check with the court listed on the citation to find out for certain.

More information on driving without insurance and not maintaining the required SR-22 is listed under TN Code Title 55, Chapter 12.Here it states:

When a policy of insurance or a bond issued to any person, when required under TN law, shall have been canceled or terminated, the commissioner shall suspend the license and registration of such person unless the person has filed proof of another policy or bond meeting the requirements given to them, and such person shall immediately surrender license and registration to the commissioner. Any notice of suspension shall be sent by United States mail to the last known address of such person not less than twenty (20) days prior to the effective date of suspension, and shall state that the operator, owner, or both, are entitled to an administrative hearing.

Any person whose license or registration, or both, has been suspended for failure to maintain evidence of financial responsibility shall, upon reapplying for such license or registration, refile and maintain with the commissioner evidence of financial responsibility, pay a sixty-five dollar ($65.00) restoration fee and pass the driver license examination.
