QuestionInsurance Question  I got a speeding ticket in West Virginia going 34 in a 25. The police officer said that all I needed to do was pay a fine and since it was only nine miles over the speed limit I would not get any points on my license. According to the point systems list that the WV DOT Division of Motor Vehicles has there are 2 points assigned to citation violations for speeding 5 to 9 mph above posted limit.

The West Virginia DMV also notes that points are assessed for traffic violations according to the severity of the offense. Motorists who accumulate 6 to 8 points against their license receive a warning letter urging them to exercise more caution and obey all traffic laws. Continued unlawful driving can lead to license suspension.

Points for a given infraction remain on a driver’s record for two years after the date of the driver’s conviction for that infraction; the infraction itself remains on a driver’s record for seven years. License suspensions run consecutively; points accumulated by drivers already under suspension will result in an additional license suspension, to begin after the original suspension period ends.

Points are assessed for all traffic violations committed anywhere in the US. Drivers convicted of multiple offenses arising out of the same incident will be assessed only the points appropriate to the most serious offense.

Since the officer giving you the speeding ticket told you that the ticket would not have points associated with it contact the court listed on the ticket and/or the WV DMV to find out for certain if points will be assigned if you plead guilty, pay the fine and thus are convicted of the offense.

If points are assessed then you may want to see about taking traffic school to get the points taken off of your record and get back to a zero total. According to the WV DOT the DMV may deduct three points from the licenses of drivers who complete an approved Defensive Driving Course.
