QuestionInsurance Question  I was in an accident that was the other drivers' fault. After obtaining a police report and an estimate of my damages I tried to file a mini-tort with the insurance company the man had listed and told the police he had. I got a call from the insurance company that his policy had been canceled in January because he had a lien on his SUV and a suspended license too. They sent me back my papers and now I am stuck trying to find out how to take care of this situation so that I can get my damaged vehicle fixed. I need to find out if he has insurance here in Michigan and soon so that I can sue him. I know that if a motorist does not have coverage in Michigan and he is at fault that I can sue him. How do I find out if he is covered or not?

In Michigan, you can first check with the Secretary of State's office to see if by giving the person's information from the police report they can give you information on if the person is insured and if so by what insurance company. If the SOS office cannot help you they should be able to advise you on which other state agency can.

You may also want to inform the police division that took the police report that the information that was listed for the other driver on the report was incorrect due to that policy being canceled months before the accident.

Once you find out if the person has insurance or not, likely not since they gave their old insurance card to the police officer, you can then go about suing them personally for the mini-tort. This Michigan consumer publication helps explain how to go about taking the at fault part to court.
