QuestionInsurance Question  I just received a speeding ticket in the state of Florida for going 15 over the speed limit. Unfortunately, this is my second one in 4 months and prior to these two tickets I received one more speeding ticket (over a year ago). How many points will I receive? And will this affect my insurance?

AnswerAuto Insurance Answer

In Florida speeding 15 mph or less over the posted speed limit is 3 points while speeding 16 mph or more over the limit is 4 points according to the Florida violation list. So for this latest traffic ticket you will receive 4 points on your FL driving record. For the other speeding violations it will depend upon how many miles over the speed limit you were cited for as to how many points were added to your license.

Keep in mind that if you receive 12 points in 12 months in Florida you will have your license suspended for 30 days. Or if you receive 18 points in 18 months then your license can be suspended for 3 months (90 days).

If you want to know how many points you have on your license at this point you can contact the Florida Department of Highway Safety and Motor Vehicles (HSMV) for a copy of your driving record.

If you have not yet plead guilty to this speeding violation then you may want to see if you can take traffic school. In Florida if you receive a ticket for a non-criminal moving violation, and you do not hold a commercial driver license, you may elect to attend a basic driver improvement course in lieu of points on your driving record.

Another benefit of traffic school, beyond the points not being added to your driver license record, is that fine is reduced up to 18 percent. In Florida, you can only choose this option for moving violations 5 times in a lifetime and cannot have made this same election in the preceding 12 months.

As for your insurance, with 3 speeding convictions within a period of a year or two it is likely that your rates would go up. However it is up to your insurance provider's rating system if your rates would rise and if so by how much. You can check with your insurance agent to find out about the rating system your insurer has in place, or you can contact the FL insurance regulatory body with whom rates must be filed with.
