QuestionInsurance Question  My hood flew up and busted my windshield and I only have PIP. Does the Florida law state that the insurance company has to fix my broken windshield?

AnswerAuto Insurance Answer

No, if you only have Florida's minimum required auto insurance of property damage (PD) liability and PIP (personal injury protection) then state laws do not require your insurance company to fix your windshield.

In Florida state laws require insurance companies to waive the deductible for windshields however you need to have physical damage coverages on your car since neither PD or PIP cover your own vehicle.

Florida Statute 627.7288 states that the deductible shall not apply to windshield damages. However, as we mentioned above you must have either comprehensive or collision coverage. A policy that provides liability coverage only will not cover your windshield.
