QuestionInsurance Question  I was caught speeding 73 in a 50. I received three tickets, the speeding, no turn signal, and careless driving. This all occurred at one stop and it was on my NJ provisional drivers license. I would like to know if the state will suspend my license or if I will get to keep it but have to take a remedial driving course.

In New Jersey it is 4 points for exceeding maximum speed 15-29 mph over limit. It is 2 points for failure to give proper signal and another 2 points for careless driving. So if you plead guilty and are convicted of all 3 violations then you will have 8 points on your driving record that is attached to your NJ provisional license.

Your record is reviewed every time points are added to it. If you accumulate six or more points within three years from your last posted violation, you will receive a $150 surcharge plus $25 for each additional point.

Surcharges are levied in addition to any court-imposed fines and penalties. According to the NJ Motor Vehicle Commission, surcharges remain operational if a motorist has six or more points resulting from violations posted in the preceding three years. If you do not pay your surcharges, MVC will suspend your driving privileges indefinitely and take action in the State Superior Court.

If you get 12 or more points on your current driving record, your license will be suspended. Point totals are based on the date the violation was posted, not when the violation occurred.

Although MVC keeps a permanent record of all the points you have earned, it is possible to earn point deductions by remaining violation and suspension-free for one year or by taking qualified driving courses approved by MVC. With the Driver Improvement Program one may use it to subtract 3 points once every two years.

When you are issued a driver license permit for the first time, you become a probationary driver. So if you have only your provisional license it is likely that you are still in your probationary phase. During the two-year probation period, if you are convicted of two or more moving violations with a total of four or more points, it is mandatory to enroll in the Probationary Driver School Program. Information will be given if and when you are required to attend and the fee for the program is $100.

If you complete the program, you will receive a three-point reduction and be placed on a one-year test period. If you fail to complete the program, or if you commit a violation during your test period, your driving privileges will be suspended. The period of suspension will depend on how soon the violation occurs after your take the probationary school.

From this information we gathered from the New Jersey MVC it would appear that you will need to attend the Probationary Driver School Program if you are convicted of all of these offenses that you were cited for at this one traffic stop. You will then be placed on another probationary or test period of one year and if you commit any violations in a vehicle during this period your license will be suspended.
