QuestionInsurance Question  How many years do you have to carry an SR-22 in the state of Rhode Island? I was pulled over in March 2004 for speeding and the officer asked me to take a breathalyzer and I refused so my license was suspended for 3 months and I was required to file an SR-22 but I thought I was only responsible for that for 3 years, and I keep getting a renewal form from the insurance company.

AnswerAuto Insurance Answer

In Rhode Island the SR22 filing requirement period varies and is set by the court. Therefore, it may be the standard 3 years or a different period of time. To find out what length of time the court determined for you in your specific situation you should be able to contact the RI Department of Motor Vehicles.

If you find that the time period to maintain your SR-22 is up and the state of Rhode Island is not longer requiring you to carry it then the DMV or Rhode Island insurance regulator should be able to advise you what steps to take so that you can cancel the SR22 certificate / form from your insurance policy. Usually an insurance company will want proof that the SR22 can be cancelled and will no longer need to be filed on your behalf to the state.
