QuestionInsurance Question  How long does a traffic ticket stay on your record in the state of Missouri?

AnswerAuto Insurance Answer

It appears that in Missouri to remove old traffic ticket convictions from your driving record you must request it be done by the DOR. Not all traffic violations are allowed to be expunged from your record and it appears the earliest you can make the request for infractions that can be purged is 3 years from the date of the conviction.

The Missouri Department of Revenue (DOR) notes that you may submit a request (including your full name and Missouri driver license number or social security number) to have old tickets purged from your record. They state however that a ticket is not eligible to be removed if it "supports" an existing administrative suspension/revocation/denial action against the driver, or if it otherwise must remain on the record in accordance with state law.

To determine when a particular ticket may be removed from your record, please refer to MO administrative rule 12 CSR 10-24.050 or contact the Missouri DOR. Here it gives you information on when and what violations can be removed from your MVR.

It states here specifically that the Department of Revenue, when otherwise not prohibited by law, may delete from a Missouri driver record a previously recorded traffic conviction, suspension or revocation of a driving privilege if all of the certain conditions are met. There are a number of conditions listed including that the conviction in question occurred more than three (3) years previously, did not involve a commercial driver license (CDL) holder or a commercial motor vehicle, and did not cause a suspension or revocation of the individual’s driving privilege.

This MO law also notes that items deleted from a driver record pursuant to this rule shall be available to courts, administrative agencies and law enforcement agencies for purposes of prosecution, litigation, sentencing and determination of driving privileges.

If you are also interested when points will drop off your MO MVR then you should be aware that the Missouri driver's manual states that every year you drive without getting new points on your record, your points total will be reduced as follows:

  • 1 year - total remaining points reduced by one-third
  • 2 years - remaining points reduced by one-half
  • 3 years - points reduced to zero

It is noted that even though your points may be reduced to zero, certain types of convictions may remain listed permanently on your Missouri driver record. The MO driver services could give you more information on what types of offenses may remain on your driver's history.
