QuestionInsurance Question  I live in Oregon and I just found out that my insurance was cancelled about 5 weeks ago. I contacted them and let them know that I had not received any notification of owing anything left on my balance and received no notification of the policy canceling. I found out by calling with a question regarding my coverage. They say that they sent out notification, but I received nothing. They say that I can start a new policy and want to raise my premium from $514 a month to $1400 a month. Isn't there notification laws. What do I do?

Yes, there are notification laws in Oregon.

According to the Oregon Insurance Division, your company must send you notice at least 10 days in advance of canceling your policy for nonpayment. If your policy has been canceled or "non-renewed" for a reason other than nonpayment, the company must give you at least 30 days’ advance notice. An explanation of the reasons for the cancellation or non-renewal must be part of or accompany the notice.

Under Oregon law, insurance companies must be able to prove notice was sent but not that you received it. It is your responsibility to tell your insurance company if your address changes and to keep track of your payments.

So in Oregon if you do not pay your premiums, an insurance company can cancel your personal auto policy by giving 10 days' written notice. The company is required to give you 30 days' written notice if it is canceling your policy for any other reason.

Per Oregon law your insurer must prove that they sent notice to you of the cancellation so you should ask them for that proof. Oregon Revised Statute 742.568 is titled Proof of cancellation or nonrenewal notice. Here it states that proof of mailing notice of cancellation, or of intention not to renew or of reasons for cancellation, to the named insured at the address shown in the policy, shall be sufficient proof of notice.

With such a large difference now in your rates with your current insurance provider you should shop around to find lower rates. Car insurance prices vary widely from one insurer to another so comparison shop and see if you can find reasonable rates even with this cancellation on your record.
