QuestionInsurance Question  Does North Dakota remove violations from driving record by using the violation date or the conviction date? I was convicted of reckless driving in October but the violation date was in July.

AnswerAuto Insurance Answer

The North Dakota Department of Transportation (DOT) is the keeper of driving record. So we contacted the ND DOT directly to find out when tickets are placed on your record and then removed. According to the DOT representative, tickets are placed on record when you are convicted of an offense and they come off by the date of conviction. Violations stay on your driving record for 3 years normally. If you have a serious offense such as a DUI though it will stay on record for 7 years but for insurance purposes can only be rated for for 3 years.

So violations are placed on your North Dakota driving record by the conviction date and thus would come off using the conviction date, not the violation date. So you would have to wait until your reckless driving conviction date in October for the offense to come off of your record, three years after you were convicted of the charge.

Here are some of the laws surrounding a driver's record in North Dakota.

According to the North Dakota Century Code 39-06.1-10 when a report of a conviction of a traffic offense, or admission or adjudication of a traffic violation is received by the licensing authority, the licensing authority shall proceed to enter the proper number of points on the licensee's driving record, unless the number points assigned to the violation are two or less.

If the number points assigned to the violation are two or less, the violation and points may not be entered on the driving record but must be recorded separately, and the separate record shall not be available to the public. Points from violations in which the assigned number points are two or less shall be considered a part of the driving record only for purposes of point reduction and for purposes of license suspension.

NDCC 39-06-22 states that the director shall file all accident reports and abstracts of court records of convictions received by the director under the laws of this state and in connection therewith maintain convenient records or make suitable notations in order that an individual record of each licensee showing the convictions of such licensee and the traffic accidents in which the licensee has been involved shall be readily ascertainable and available for the consideration of the director upon any application for renewal of license and at other suitable times.
