QuestionInsurance Question  I have a New York State Learners Permit and am driving in California with a licensed driver. Am I allowed out of state in California with a NYS permit?

According to the New York new driver's brochure, a motorist with a learner's permit, junior permit or junior license may drive outside of New York State if it is allowable by the laws of the other state(s).

If you drive out of New York, you must obey that state's learner or junior permit and license restrictions that may apply. The NYS DMV suggests that you check with the police or motor vehicle authorities of the states which you plan on visiting in your automobile.

The state of California has very specific rules regarding non-resident minors that want to operate a vehicle in CA.The California Department of Motor Vehicles (DMV) states that:

Visitors over 18 years old with a valid driver license from their home state or country may drive in California without getting a driver license as long as their home state license remains valid.

Visitors between 16 and 18 years old may drive with their home state license or instruction permit for only 10 days after arriving in California. After the 10 days, they must have either a:

  • California driver license, or
  • Nonresident Minor’s Certificate which is issued by DMV to a minor who has given proof of financial responsibility.

Minors between 16 and 18 years who are California residents must have in their possession a valid California provisional license or a valid California license. Nonresident minors must have in their possession a valid license from their state of residence and a Non Resident Minor's Certificate issued by the CA Department of Motor Vehicles.

You can contact the CA DMV to get more information on the laws California has in place for out of state minors operating a car there and how to option a non-resident minor's certificate. They also can advise you if you will need to follow your home state's restrictions for your permit and/or if they have certain conditions you must follow when driving with your NYS learner's permit.
