Unless you are the entity that issued the license, you are not authorized to revoke a drivers license. You do have options though.

The Oklahoma Department of Public Safety regulates private passenger auto insurance requirements so we contacted them to find out how you would start the process of getting the license of the person driving without insurance suspended or revoked. They responded that you should contact the Driver Compliance Division at (405) 425-2098 or (405) 425-2059 for information on how to report a person that is driving without insurance and/or you were in an accident with and they did not have proof of insurance.

Oklahoma Motor Vehicle section 7-606 is the state law for failure to maintain security on a motor vehicle. Here it states that an owner or operator who fails to comply with the Compulsory Insurance Law of OK shall be guilty of a misdemeanor and upon conviction shall be subject to a fine of not more than Two Hundred Fifty Dollars ($250.00), or imprisonment for not more than thirty (30) days, or by both such fine and imprisonment, and in addition thereto, shall be subject to suspension of license and registration.

The suspension that we mentioned earlier is referred to more in the DPS Rules Financial Responsibility chapter, 595:15-1-4, where it discusses suspension for no vehicle liability insurance. Here it states that when the owner fails to timely furnish proof of vehicle liability insurance or of the Department shall immediately suspend the owner's driving privilege and driver license and the registration(s) and license plate(s) of any uninsured motor vehicle registered in the owner's name. The suspension shall remain in effect until payment of the required fees as provided by statute and proof of insurance is presented.

Keep in mind if you were involved in an accident in which the other driver was at fault and had no liability insurance your rates should not increase if you have to file a claim through your own auto insurance policy. No. Section 941 of the Oklahoma Insurance Code says that a company cannot assign driving record points, cancel, refuse to renew or increase the premium rate for any motor vehicle liability or collision insurance policy for the reason that the insured has been involved in a motor vehicle collision and was not at fault.

The Oklahoma Insurance Department may also be able to tell you more about how to make sure a person is properly cited and penalized for driving without insurance and causing an accident.
