QuestionInsurance Question  Why is North Carolina so different and annoying with their insurance requirements in 2009?

AnswerAuto Insurance Answer

North Carolina is different from most states for car insurance, please read about ceding in North Carolina to learn more of the differences.

In 2009, some new laws go into effect requiring more car insurance. Effective January 1, 2009, North Carolina House Bill 738 requires all North Carolina automobile insurance policies to include Uninsured Motorist Coverage and, if applicable, Underinsured Motorist Coverage. The law requires that Uninsured Motorist Coverage be equal to the highest limit of Bodily Injury and Property Damage Liability Coverages for any one vehicle insured under the policy, unless the insured elects to purchase higher limits.
Underinsured Motorist Coverage is required for insureds that purchased a policy with Bodily Injury Liability Coverage with limits greater than $30,000 per person/$60,000 per accident. The law requires the Underinsured Motorist Coverage to be equal to the highest limits of Bodily Injury Liability Coverage for any one vehicle insured under the policy, unless the insured elects to purchase higher limits.

NC is different because they have two coverage options for Uninsured Motorist Bodily Injury coverage. You can purchase Uninsured Motorist Bodily Injury without Underinsured Motorist Bodily Injury coverage, or you can purchase combined Uninsured/Underinsured Motorist Bodily Injury.

With the new law, if you have Bodily Injury Liability coverage with 30/60 limits then you can purchase Uninsured Motorist Bodily Injury with 30/60 limits or higher. If you have Bodily Injury Liability coverage with limits higher than 30/60 then you must purchase Uninsured/Underinsured Motorist Bodily Injury with equal or less limits.

Some carriers will not offer Uninsured Motorist Bodily Injury and will only offer the combined coverage Uninsured/Underinsured Motorist Bodily Injury. Uninsured Motorist Property Damage is now required too with limits equal to Property Damage Liability limits.
