QuestionInsurance Question  My husband and I own a car (in Kentucky) that has not been running for 6 months and is probably beyond repair. Can we drop the insurance on it and if so what are the steps we need to take to insure that we will not be penalized for no insurance?

The Kentucky Transportation Cabinet notes that KY law specifies that 'Motorized' vehicles 'Registered' in the Commonwealth must be covered by Liability insurance.

Kentucky requires Liability coverage in the amounts of 25/50/10. These numbers stand for $25,000 total for bodily injury per person, $50,000 total for bodily injury coverage per accident and $10,000 total for property damage per accident.

The penalties for driving without insurance in KY can be quite harsh. For a first offense you are cited to go to court and can be fined between $500 and $1000 or be imprisoned for not more than 90 days or both.

Furthermore your Kentucky motor vehicle registration and license plates can be suspended for one year or until proof of insurance is provided. You also could lose your license for up to a year. The penalties increase for each subsequent violation of not having proof of auto insurance.

So you do not want to be found by the Commonwealth of Kentucky without insurance on your vehicle, even though it is inoperable, as long as it is registered with KY. Typically if you turn in your registration and plates you can then take insurance off of a car, especially one that is no longer running and may not be able to be repaired.

Contact the KY Transportation Cabinet directly to see what steps to take in order to not be penalized for taking insurance off your inoperable vehicle. Also if you plan to keep the vehicle, instead of selling it for salvage, etc, than find out where you are legally allowed to park since it will be without registration and insurance.

Kentucky has a law, that applies to owners or occupants of land in a city, county, or unincorporated area, which requires junked, wrecked or inoperable vehicles (including parts cars) stored on private property to be maintained out of ordinary public view. So check with the Kentucky Transportation Cabinet to make sure you will not get penalized either for where you keep this vehicle.
