Massachusetts Toyota owners who believe they got into accidents due to pedal problems can appeal recent or even old car-insurance surcharges, the state Division of Insurance has ruled.
Regulators decided Friday that owners of vehicles covered by Toyota's massive recall can ask to reverse surcharges if consumers can prove that uncontrolled auto acceleration caused their accidents.
"In light of the recently announced recall of certain models of Toyota vehicles for unintended acceleration, the Division of Insurance is issuing this (ruling for) drivers who may have received an at-fault determination as a result of (an) accident," officials wrote in a consumer alert.
Car owners who want to reverse surcharges must prove they were driving models covered by the recall, and must show that uncontrolled acceleration caused an accident.
Drivers must also lodge appeals - which cost $50 in some cases - by March 30 or within 60 days of getting a recall notice, whichever is later.
