I rear-ended someone today. Do I pay a deductible if it is just the other car getting fixed? My car is fine and they only got a tiny mark on their bumper the size of a dime (which was from the the screw holding my license plate).I'm trying to decide if I'm better off going through the insurance or paying the other party the $800 estimate. I was involved in an accident in Florida. The other driver who flew out in front of me was at fault. It was his 3rd DUI and the state officer at the scene got his insurance information. He was arrested and the next day I filed a claim with that information that was in the report. The insurance company said he was not the policy holder or a driver on the policy and even the vehicle was not on the policy. How can I find out if this guy has insurance and if his car was insured? My car was declared a total loss by my insurance company. The car is drive-able and all lights and turning signals work just the back is dented and the trunk will not close. The insurance company is saying that we have to sign the title over to them for salvage and we receive a check. They say we have no say so in it, that it is state law that if a car is under 8 years old and the insurance company claims it a total loss we can not have our car back.
